The amended Chemical Law 2025 will take effect on January 1, 2026 with many important changes. In particular, administrative procedures will change in accordance with new regulations.

1. What is a Schedule 1 chemical production license?

1.1. Table chemicals

Table chemicals are toxic chemicals and precursors controlled under the provisions of the Convention on the Prohibition of Chemical Weapons and are classified in the order of 1, 2 and 3 according to the criteria specified in the Chemical Annex to the Convention on the Prohibition of Chemical Weapons. Table chemicals include substances on the List and mixtures of substances containing substances on the List.[1]

1.2. Chemical manufacturing license Schedule 1

A Schedule 1 chemical production license is a license issued by a competent State agency to organizations and individuals engaged in chemical production activities in Appendix I of the List of Schedule 1 chemicals[2] specified in Decree 33/2024/ND-CP on the implementation of the Convention on the Prohibition of Development producing, stockpiling, using and destroying chemical weapons.

1.3. Conditions for issuance of Schedule 1 chemical production licenses

1.3.1. Production Conditions

Being an enterprise established in accordance with the law;
Physical and technical facilities must meet the requirements in production as prescribed in Clause 1, Article 8 of Decree 33/2024/ND-CP;[3]
The director or deputy technical director or technical officer in charge of chemical production activities must have a university degree or higher in chemistry;
The subjects specified in Article 32 of Decree No. 113/2017/ND-CP must be trained in chemical safety.

1.3.2. Other conditions

It is only allowed to produce Schedule 1 chemicals for one or several special purposes specified in Clause 2, Article 6 of the Law on Investment, including analysis, testing, scientific research, healthcare, pharmaceutical production, criminal investigation, national defense and security protection;
The scale of production at single-scale establishments, the capacity of reactors does not exceed 100 liters, and the total capacity of reactors with a capacity of more than 5 liters does not exceed 500 liters. The scale of production at other establishments, the total output must not exceed 10 kg/year for protection purposes; the output must not exceed 100 grams/year for a chemical but the total output must not exceed 10 kg/year for research, medical or pharmaceutical purposes; The total output does not exceed 100 grams/year for laboratories.

Copies of papers proving the right to use the land plot for construction of factories and warehouses or lease contracts for factories and warehouses; A copy of a bachelor's degree or higher in chemistry of the Director or Deputy Technical Director or a technical officer in charge of chemical production activities; A copy of the Decision on recognition of the results of chemical safety inspection and training as prescribed in Article 34 of Decree No. 113/2017/ND-CP, amended and supplemented in Decree No. 82/2022/ND-CP; A copy of the approval decision or a written certification of documents related to environmental protection as prescribed by law issued by a competent state management agency; A copy of the written approval of the results of the fire prevention and fighting acceptance test of the fire prevention and fighting police agency for each production establishment subject to fire prevention and fighting design appraisal and approval. A copy of the record of fire prevention and fighting safety inspection or a competent agency's document proving the satisfaction of fire prevention and fighting safety conditions for each production facility that is not subject to compulsory fire prevention and fighting design appraisal and approval; A written commitment to produce Schedule 1 chemicals for one or several special purposes is specified in Clause 2, Article 6 of the Law on Investment, including analysis, testing, scientific research, healthcare, pharmaceutical production, criminal investigation, national defense and security protection.
