Building Your Organization’s Cross-Border Data Transfer Toolbox”. HM&P lawyers actively engaged in discussions with participants from various countries, gaining practical knowledge and insights to enhance their legal advisory capabilities.

Children today access digital platforms such as YouTube, Facebook, TikTok, and online games earlier than ever. However, they are often vulnerable due to their limited awareness of privacy risks. This masterclass covered key legal frameworks under Singapore’s Personal Data Protection Act (PDPA), and through real-life case studies, participants learned how to design digital experiences that are both safe and compliant for children.

Mr. Phuc emphasized that, similar to many jurisdictions, Vietnam considers children a vulnerable group with limited capacity to protect themselves against data exposure. Vietnamese laws have introduced specific safeguards for children in cyberspace, especially given their early exposure to technology. Businesses offering services or products to children must prioritize compliance with child data protection regulations, which is a legal obligation that cannot be delayed.

2. Insights from Senior Associate Nguyen Nhat Duong from Why Borders? Building Your Organization’s Cross-Border Data Transfer Toolbox
Global businesses are increasingly facing challenges in managing cross-border data transfers in a legally compliant and efficient manner. As more countries tighten regulations on international data flows, it is essential for enterprises to clearly understand how to meet legal requirements in the context of cross-border operations.

The masterclass, jointly organized by the Singapore Corporate Counsel Association (SCCA) and the Asian Business Law Institute (ABLI), addressed recent developments in the region and explored practical transfer mechanisms such as the Global Cross Border Privacy Rules (CBPR), ASEAN Model Contractual Clauses (MCCs), and intra-group agreements. HM&P lawyers not only gained theoretical knowledge about cross-border data governance but also engaged in practical exercises to apply their legal expertise in implementing these mechanisms effectively.
Cross-border transfers of personal data are a common activity among businesses, particularly in the context of global integration and multinational operations. Complying with the legal requirements of each jurisdiction while maintaining operational efficiency requires companies to identify suitable legal tools and practical solutions to address this complex challenge.
