    HM&P Managing Partner responds to VOH interview regarding the business's responsibility for compliance with personal data regulations on protecting

    On June 7th, 2024, Lawyer Nguyen Van Phuc - Managing Partner of HM&P shared and expressed some of his views on the issue of personal data protection in enterprises through an online interview with The Voice of Ho Chi Minh City People (VOH Online) on the program "Business and Law". Then, on June 12, 2024, during a talk show on VOH with the Chairman of GC Food Joint Stock Company, Mr. Nguyen Van Thu, Managing Partner of HM&P Law Firm, shared the detailed and practical insights on this issue through the consulting and training experiences with enterprises in recent times.

    Through interviews and discussions with enterprises, Mr. Phuc raised a number of issues that enterprises need to pay attention to in the coming period, as follows:

    Decree No. 13/2023/ND-CP on Personal Data Protection is considered a new and important decree issued by the Government in April 2023, which came into effect on July 1, 2023. After almost a year of practical implementation, businesses still face many confusions and concerns in complying with these regulations. Especially in the coming period, when the Government will issue a Decree on Sanctioning Administrative Violations for Compliance with Regulations on Personal Data Protection, enterprises must pay even more attention and strictly enforce the regulations. According to Mr. Phuc, in addition to grasping and understanding the regulations on personal data protection, enterprises need to review and establish procedures, build secure information systems, and train professionals and other staff within the enterprise, all of which are urgent tasks. In addition, companies also have obligations to government authorities when proactively reporting the impact of processing personal data or transferring personal data abroad. These are administrative procedures that companies must follow when processing data on employees, customers, partners, etc.

    Compliance with Decree 13 on the Protection of Personal Data is a challenging process for businesses, especially small and medium-sized enterprises with limited human, technological and financial resources. However, regardless of the size of the business or the industry it operates in, businesses must understand that compliance with regulations to protect the personal data of employees, customers, and partners is extremely important in the daigital age.

    In the interview, Lawyer Phuc also added information that although there are currently no specific sanctions for violations of Decree 13, the Ministry of Public Security is also in the process of developing and proposing a draft decree on administrative sanctions in the field of cybersecurity, which is expected to take effect in June 2024. Therefore, Lawyer Nguyen Van Phuc has raised some noteworthy points for businesses to effectively comply with Decree 13, mitigate risks, and avoid administrative sanctions for non-compliance or incomplete compliance with personal data protection regulations within their businesses.
