    Accurate preparation and completion of forms related to work permits (WP) are essential steps for both enterprises and foreign workers to ensure compliance with current Vietnamese laws. In this article, HM&P provides a comprehensive guide and practical notes on how to complete these forms, ranging from legal information to specific requirements for each job position, to help businesses prepare their applications efficiently, completely, and in accordance with regulations.

    Instruction:

    (1) Ministry of Home Affairs (Department of Employment) or local Department of Home Affairs where the foreign worker is expected to work.

    (2) Record the actual usage, including foreign workers who have signed and have not signed employment contracts.

    (3) Enterprises choose, according to their needs, to issue/ renew/ reissue a work permit. If they register multiple related procedures at the same time, each procedure must register 1 item. For example: I. Issue; II. Extend; III. Reissue.

    (4) Choose 1 of 4 job positions: manager/ executive/ expert/ technical worker.

    (5) Enterprises shall declare themselves. The job title must be clear, consistent with the unit’s field of operation and the job description such as Head of Mechanical Engineering Department, Head of Information Technology Project Supervision Department, Technical Staff of the production line/ team, etc. It should not be written in general terms such as Head of Technical Department, Head of Project Department, Technical Staff, etc.

    (6) List specific locations and clearly state each location in order: house number, street, hamlet, village; commune/ ward/ town; district/ town/ city under province; province/ city directly under the central government.

    In case the foreign worker works at a dependent unit, fully record the legal information of that workplace (name of dependent unit, dependent unit code, dependent unit address).

    (7) Specify the number of foreign workers, position and job title, work permit or confirmation of subjects not required for a work permit, and working period.

    (8) Clearly state the training level and training major. Note that do not use phrases with unclear meanings or without a basis for assessment such as “equivalent”, “related”,...

    (9) Experience requirements corresponding to each job position being explained (Article 3 of Decree 152/2020/ND-CP (amended and supplemented by Decree 70/2023/ND-CP)).     If choosing the form of intra-corporate transferee, the name of the foreign enterprise sending the employee to work in Vietnam and the number of years worked at the sending foreign enterprise must be clearly stated.

    (10) Clearly state the reasons why the enterprise cannot recruit Vietnamese workers for the positions expected to employ foreign workers, including information about the recruitment process that the enterprise has conducted on the Electronic Information Portal of the Ministry of Home Affairs or the Electronic Information Portal of the local Employment Service Center where the foreign workers are expected to work ( the process of notification, recruitment, and results of recruitment of Vietnamese workers for the positions expected to employ foreign workers). When submitting the application, attach supporting documents and information (if any).

    (11) Ministry of Home Affairs (Department of Employment) or local Department of Home Affairs where the foreign worker is expected to work.

    Instruction:

    (1) The enterprise shall fill in the titles that corresponding to the needs.

    (3) Approval document for the demand to employ foreign workers from the competent authority that the enterprise has submitted when explaining the need to use foreign labor.

    (4) Actual salary paid to foreign workers.

    (5) The working period has been approved according to the approval document for the demand to employ foreign workers by the competent authority. In case of re-issuance, fill in the time from the date of submission of the re-issuance application to the final working period of the work permit being requested for re-issuance.

    (6) Re-issuance and extension of work permit do not require providing information in Section I, II.

    (7) The working period before the application for a work permit is currently submitted, in case of multiple workplaces (from 4 places or more), provide information of up to 3 previous workplaces (including the working time proving work experience).
