The procedures to establish a representative office of the foreign enterprise trading in tourism service

Implementing agency

Department of Culture, Sports and Tourism or Department of Tourism (for provinces or cities that establish the Department of Tourism) where the representative office (“RO”) is located.

Means of application

The foreign enterprise trading in tourism service (“FETTS”) submit an application to the Department of Culture, Sports and Tourism or the Department of Tourism by one of the following means:

• Direct application; or
• Application via post; or
• Online application (if applicable).

The FETTS shall priorly check the information on the means of application at the implementing agency where it expects to submit the application to find out the most effective means of application

Dossier components

The application comprises:

a. Application Form (following Form MĐ-1 of the Appendix attached to Circular 11/2016/TT-BCT dated 5 July 2016) signed by the representative of the FETTS;

b. The true copy of the business license or equivalent documents of the FETTS;

c. The document made by the FETTS to designate the head of the RO;

d. Audited financial statements or certificates of fulfillment of tax liabilities or financial obligations of the last fiscal year or equivalent documents as proof of existence and operation of the FETTS issued or certified by competent authorities where it is established.

e. The copy of the passport or the ID card (for Vietnamese) or passport (for foreigners) of the head of the RO;

f. The documents related to the expected location of the RO comprises:

• The copy of the memorandum or the lease agreement or the copy of the document proving the FETTS has the right to exploit or use the location of the RO;
• The copy of the document presenting the place where the RO is expected to be located.

Note 01

Components at (b), (c), (d), (e) (for the situation where the copy of the passport held by a foreign head of RO) must be translated into Vietnamese and certified in accordance with Vietnam laws.

Note 02:

The copy of the business license or equivalent of the FETTS must be legally certified or legalized by the overseas diplomatic agency or consulates of Vietnam under the laws of Vietnam.
